Terrorism-related liability risk is high magnitude and largely uninsurable. 9/11 litigation alone produced risk exposures over $10B, and legal fees in the 10's (if not 100's) of millions of dollars. And the litigation can drag on for years and consume valuable time and resources.

Fortunately, the US Government recognized this potentially enterprise-crippling liability exposure, and passed the US SAFETY Act (as part of the Homeland Security Act of 2002), which provides valuable limitation of liability for companies that meet certain criteria specified by the Department of Homeland Security for declared acts of terrorism. The SAFETY Act caps potential liability at a readily-insurable level (that most companies already carry), and customers of a SAFETY Act-covered company can be shielded from terrorism-related liability - a powerful marketing tool.

As a benefit to C-TPAT participants, Customs and Border Protection has negotiated for C-TPAT Tier 3 to be a part of this government limitation of liability program.

This benefit is easy to qualify for as well. C-TPAT Tier 3-qualified companies need only provide evidence of their Tier-3 qualification and evidence of insurance coverage. And best of all - there is no government filing fee associated with the streamlined application (and its processing by DHS) to obtain protection under the SAFETY Act.

Dale Svenson, Enterprise Risk Management, Boeing

As Senior Manager of the Risk Management & Insurance group within Boeing Finance, Dale is responsible for maintaining and executing significant business risk processes and reviews for the Boeing enterprise and subsidiaries. This scope includes management of terrorism-related risk for company security products and services through leveraging the US SAFETY Act. Prior to focusing on corporate risk full time in 2010, Dale was responsible for managing Homeland Security R&D for the Boeing Research & Technology organization.

Akmal Ali, Principal, Catalyst Partners

Akmal formerly served as the Deputy Director of the SAFETY Act Office within the U.S. Department of Homeland Security (DHS). During his time at SAFETY Act Office, Akmal helped expand the program to provide coverage to security services including aviation and cargo security related services. Akmal helped developed one of DHS's first SAFETY Act Block Designation and assisted in the creation of the C-TPAT Block Designation. Akmal is a principal at Catalyst Partners, a homeland security consulting firm located in Washington, D.C. Akmal graduated from Syracuse University College of Law and its Institute of National Security and Counterterrorism.
